California’s 10-Year DUI Lookback Period

The calculation runs from the date of arrest on the earlier offense to the date of arrest on the new offense, not from the conviction date. If that span exceeds 10 years, a new charge generally proceeds under first-offense penalty provisions rather than repeat-offender enhancements.

Some prior offenses that people don’t expect can still count toward that window. A wet reckless plea under Vehicle Code section 23103.5 qualifies as a prior DUI for lookback and enhancement purposes. An out-of-state conviction for conduct that would constitute DUI under California law can also count. One other point worth understanding: a DUI conviction remains on your criminal record indefinitely regardless of the lookback window. That window controls only whether the prior triggers sentencing enhancements on a new charge, not whether the conviction exists.

How Penalties Escalate for Repeat DUI Convictions

When a prior conviction falls inside the 10-year window, California law imposes mandatory minimum penalties that increase with each subsequent offense. The differences are significant.

Second DUI Conviction

Under Vehicle Code section 23540, a second DUI conviction within the lookback period carries a mandatory minimum of 96 hours up to one year in county jail. It also triggers a license suspension of up to two years and requires completion of an 18-month DUI education program. Restricted license eligibility during that suspension generally requires installation of an ignition interlock device (IID), a breath-testing device wired into the vehicle’s ignition.

Third & Subsequent DUI Convictions

The exposure increases further for a third DUI conviction, which can carry a mandatory minimum of 120 days up to one year in county jail. If the offense involves injury or other aggravating factors, felony exposure and state prison time starting at 16 months can become a possibility. A 30-month DUI education program is also required. A fourth or subsequent conviction within the 10-year window can be charged as a felony.

Defense Strategies Specific to Multiple DUI Allegations

Defending a multiple DUI charge starts with the same foundational review as any DUI case: whether the traffic stop was lawful, whether field sobriety tests were properly conducted, and whether breath or blood test results are reliable, including calibration records and compliance with Title 17 of the California Code of Regulations. But repeat allegations add a layer that isn’t present in first-offense cases.

The threshold question is whether each prior conviction actually falls within the precise 10-year window. Because the window runs arrest date to arrest date, a prior that appears recent on paper might fall outside it on the actual dates. A prior conviction can also be challenged on constitutional grounds if the defendant wasn’t properly advised of the right to a trial, the right against self-incrimination, and the right to confront witnesses when entering that earlier plea. Successfully excluding a prior from the lookback calculation can result in a current charge being sentenced under first-offense sentencing exposure, which is a substantial difference in potential consequences.

The Separate DMV Process After a Repeat DUI Arrest

A DUI arrest triggers two separate proceedings: the criminal case in court and the DMV’s Administrative Per Se (APS) action to suspend your driving privileges. These run on different timelines, and one doesn’t wait for the other.

You have 10 days from the date of arrest to request a DMV hearing. Missing that deadline makes the suspension automatic, regardless of how the criminal case resolves. For repeat offenders, California’s statewide IID program generally requires installation of an ignition interlock device as a condition of obtaining a restricted license during the suspension period. Requesting the DMV hearing promptly and managing both proceedings in parallel is part of how we approach these cases.
