How California Defines Robbery Under PC 211

California Penal Code 211 defines robbery as the felonious taking of personal property in the possession of another person, from their person or immediate presence, against their will, by means of force or fear. Every word in that definition carries legal weight. To convict, the prosecution must prove each element beyond a reasonable doubt under CALCRIM 1600: property was taken from another person’s possession and immediate presence, against their will, using force or fear, with the intent to permanently deprive that person of the property.

The force or fear element is what separates robbery from theft. Without it, a charge may be reduced to grand theft or petty theft. This distinction also separates robbery from burglary, which focuses on unlawful entry into a structure with criminal intent, even if no property is taken and no person is present. Robbery requires direct confrontation. And unlike most theft offenses, PC 211 is never a wobbler: all degrees are charged as felonies.

First-Degree vs. Second-Degree Robbery in California

California Penal Code 212.5 divides robbery into two degrees based on the circumstances of the offense. First-degree robbery applies when the victim is a driver or passenger of a vehicle used to transport persons for hire (such as a bus or taxi), when the offense occurs inside an inhabited dwelling, or when the victim is using or has just used an ATM. A robbery committed inside an occupied residence by two or more participants may be charged as home-invasion robbery, which carries higher penalties. All other offenses that don’t meet those criteria are charged as second-degree robbery.

The sentencing ranges differ significantly between the two degrees:

Robbery convictions under PC 211 aren’t eligible for split or suspended sentences under PC 1170(h). If probation is denied, state prison time must be served.
